AI Sand Art Terms of Service

1. Acceptance of Terms

By accessing or using SandArtAI, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the service.

2. Eligibility and Accounts

You must be at least 18 years old to use SandArtAI. The service is not directed to or intended for people under 18.

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account.

3. Service Description and Third-Party AI

SandArtAI provides AI-powered image generation and transformation features. We may add, remove, or change features over time.

Generation requires third-party AI processing, including Google Gemini for bounded visual analysis and Replicate for generation. Google Gemini receives the source image and fixed structured-analysis instructions; Replicate receives the source image, selected controls, compiled generation instructions, and optional user instructions. Third-party AI processing is necessary to provide the feature and is governed by our Privacy Policy and the applicable provider terms.

SandArtAI is independent from Google Gemini and Replicate. References to providers or model names describe technical compatibility only and do not imply sponsorship, endorsement, or affiliation.

4. Your Content and AI Outputs

You warrant that you have all rights or permissions needed to upload content and grant us a limited, non-exclusive license to process that content only as needed to provide, secure, and operate the service.

AI requests may be rejected for safety, policy, legal, or technical reasons. Outputs vary, may be inaccurate, incomplete, unsuitable, or nonexclusive, and may resemble outputs generated for other users. You are responsible for reviewing outputs before publishing, sharing, or using them commercially and for respecting third-party rights.

5. Acceptable Use

You agree not to:

• use the service for illegal activity;
• infringe intellectual property or privacy rights;
• attempt unauthorized access, abuse, reverse engineer, or disrupt the platform; or
• submit malware, harmful code, or prohibited content.

6. Plans, Credits, Watermarks, and Cancellation

• Subscription plans renew automatically until canceled. You can manage or cancel a subscription from the billing management portal available in account settings. Cancellation stops future renewals; access continues until the end of the current billing period.
• One-time purchases, such as credit packages, do not auto-renew. Credit validity and expiry are shown in product and account details.
• Successful generation jobs consume the displayed credits. Eligible failed or canceled jobs release reserved credits through the durable account ledger after reconciliation. The account ledger is authoritative, and a release may not be instantaneous.
• Outputs generated while a paid subscription or credit-package access period is active include commercial rights as described on the pricing page and remain subject to these Terms.
• Watermark treatment for free and paid outputs remains exactly as stated on the pricing page. These Terms do not expand the pricing page's watermark or commercial-rights promises.

7. Payments and Taxes

Payments are processed by Creem as Merchant of Record. Creem handles checkout, invoicing, and applicable tax collection.

8. Refunds

Refund requests are handled according to our Refund Policy.

9. Intellectual Property

We retain rights in the SandArtAI service, branding, and software. You retain rights to your input content, subject to the limited license above. Any use of outputs must comply with these Terms, the pricing page, and applicable third-party rights in your input content.

10. Termination

We may suspend or terminate access for violations of these Terms, abuse, legal requirements, or security risk.

11. Disclaimer and Limitation of Liability

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties and are not liable for indirect, incidental, special, consequential, or punitive damages.

12. Changes to These Terms

We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.
